We rewrote these Terms to match how CloudMess works today and the rules that apply to it. They now set out what mess owners and we each do with members’ data (§5), what must not be posted on CloudMess (§6), how complaints are handled under the IT Rules (§12), how the free trial becomes a paid subscription (§4.2), and a liability limit that, for mess owners, follows what they have paid us (§9). For members, the service and your responsibilities are unchanged.

These Terms of Service (“Terms”) govern your use of the CloudMess apps — CM Owner, for mess owners, and the CloudMess member app (together, “the Apps”) — which are run by INFIWORKS TECHNOLOGIES PRIVATE LIMITED (CIN U62090ME2026PTC476551; registered office: At 438, Shidod, Shidode, Bid, Beed – 431122, Maharashtra, India), “InfiWorks”, “we”, “us”.

By creating an account, you agree to these Terms and to how we handle data as described in our Privacy Policy. Mess owners also confirm this in writing when we set up their account. If you do not agree, please do not use the Apps. You can stop using them at any time.


The service

1. The service

CloudMess is software that helps mess owners in India run a monthly-subscription meal business, and helps their members manage attendance, meals and dues.

  • CM Owner lets mess owners set up their mess, manage plans and members, run the daily intent survey, handle tiffins and parcels, and record payments.
  • The CloudMess member app lets members scan the QR code for a meal, answer the daily survey, see their dues and pay the mess by UPI.

CloudMess is software only. We do not cook, serve or deliver food; the mess owner is responsible for the meals. We are not a party to a member’s subscription with their mess; that is an agreement between the member and the owner.


Eligibility

2. Who can use it

  • You must be at least 18 years old. A parent or guardian using the app “on your behalf” does not change this. If you are under 18, ask your mess owner to handle your membership without an app account (see Privacy Policy §9).
  • You must live in India.
  • Members sign in with an Indian mobile number (+91) and a one-time code. Mess owners sign in with an email address and a password that we set up with them at the setup visit.
  • Mess owners must run a genuine mess business in India and follow the food-safety, tax and labour laws that apply to it.

Accounts

3. Your account

  • Members: keep your phone and SIM secure; login codes go to your number.
  • Mess owners: keep your password secret and do not use it anywhere else. To change it, ask us and we will set a new one with you.
  • Tell us at once if you think someone else has used your account.
  • Do not share or transfer your account, or pretend to be someone else.
  • Keep the details you enter accurate.

Payments

4. Payments

4.1 Members’ payments to their mess

  • Members pay their mess directly, in cash or by UPI. The owner records payments in CM Owner; the member app can open your UPI app with the mess’s details filled in.
  • CloudMess never handles money between members and messes, and members pay us nothing.
  • The owner is responsible for checking that a payment arrived. Disputes are between the member and the owner; the activity log in CM Owner helps settle them, but we do not decide them.

4.2 Mess owners’ subscription to CloudMess

  • CloudMess is a paid service for mess owners, starting with a free trial. When you sign up, we tell you how long the trial lasts and what the plan costs after it.
  • Before the trial ends, we remind you. Your subscription continues only if you agree to pay for it.
  • You pay INFIWORKS TECHNOLOGIES PRIVATE LIMITED directly, by UPI, bank transfer or cash. There is no payment gateway in the app, and the app never charges you.
  • Your billing period, cancellation and refund terms are in the subscription confirmation we send you. You can cancel at any time by telling us.
  • If we change the price or terms of an existing subscription, we tell you in advance, in writing (email or WhatsApp).

Members’ data

5. Mess owners and members’ data

When a mess owner records members’ details in CloudMess, the owner decides what is recorded and why, and is responsible for it under Indian data-protection law (as the “Data Fiduciary”). We process those records only to provide CloudMess to the owner, as the owner’s “Data Processor”, and as our Privacy Policy describes.

If you are a mess owner, you must:

  • tell your members that your mess uses CloudMess and what it records. We give you a short message you can send them;
  • add only people who have agreed to be added, and never anyone under 18;
  • use members’ data only to run your mess, and keep it confidential;
  • not record health details (such as allergies), religion or caste, bank or card details, or passwords in notes or reasons;
  • deal with your members’ requests about their data (we will help you).

For each mess owner, we:

  • process members’ data only to provide CloudMess to you, as the app lets you direct, or where the law requires;
  • keep it secure, as Privacy Policy §7 describes, and use only the providers listed in its §5;
  • tell you without delay if a breach affects your mess’s records;
  • help you answer your members’ requests; and
  • when your mess leaves CloudMess, give you a copy of its records if you ask, then delete them within 90 days, except what the law requires us to keep.

Content rules

6. What must not be posted or stored

As the IT Rules require, you must not use CloudMess — including notices, notes, reasons and names — to host, display, upload, publish, send, store or share anything that:

  • belongs to someone else and you have no right to;
  • is obscene, pornographic or paedophilic, invades someone’s privacy (including bodily privacy), insults or harasses anyone on the basis of gender, is racially or ethnically objectionable, relates to or encourages money laundering or gambling, or promotes enmity between groups on grounds of religion or caste with intent to incite violence;
  • is harmful to a child;
  • infringes a patent, trade mark, copyright or other proprietary right;
  • deceives or misleads people about where a message comes from, or knowingly spreads information that is false or misleading;
  • impersonates another person;
  • threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with other countries or public order, incites an offence, prevents the investigation of an offence, or insults another nation;
  • contains a virus or other code designed to damage or limit any computer resource;
  • is, or advertises, an online game that is not a permissible online game; or
  • breaks any law.

If you break these rules, we may remove or disable the content, and suspend or close your account, immediately. Breaking them may also make you liable to penalties or punishment under the law, and where the law requires an offence to be reported, we will report it to the authorities.


Acceptable use

7. Acceptable use

You must not:

  • reverse-engineer or decompile the Apps, beyond what Indian law allows;
  • probe, scan or test the security of CloudMess without our written permission;
  • use the Apps to send unwanted messages to, or harass, anyone;
  • try to get into another person’s account or data;
  • commit fraud, such as scanning meals for someone else without permission or recording payments that were never made; or
  • use the Apps for anything unlawful.

Availability

8. Service availability

We work to keep CloudMess available, but we cannot guarantee it. It may be unavailable during maintenance (we warn you in advance where we can), during outages at our providers, or because of events outside our control.

If the member app cannot reach our servers, it keeps your meal scans on your phone and sends them when the connection returns. Not every feature works offline.


Liability

9. Limits of our liability

As far as Indian law allows:

  • we provide the Apps “as is” and “as available”;
  • we are not liable for disputes between a mess and its members about meals, hygiene, delivery times or prices, or for indirect losses such as lost profit or business;
  • our total liability for all claims about the Apps is limited to:
    • members, who pay us nothing: ₹1,000 (one thousand Indian rupees);
    • mess owners: the fees you paid us in the 12 months before the claim, or ₹1,000 if that is more.

Nothing in these Terms limits liability for fraud, gross negligence or wilful misconduct, or for our failure to protect personal data as the law requires, or any other liability that Indian law does not allow us to limit. Nothing in them takes away your rights under the Consumer Protection Act, 2019.


Suspension and closing

10. Suspending and closing accounts

By you

You can stop using the Apps at any time. To close your account and have your data deleted, follow Delete your account; we act within 30 days. Privacy Policy §6 explains what the law makes us keep. Closing a mess-owner account also closes the mess, and we tell you beforehand what will be kept and what your members will see.

Request account deletion

By us

We may suspend or close an account, or a mess, that breaks these Terms or the law, abuses CloudMess or commits fraud. We will tell you before suspending, unless we suspect fraud or immediate harm, and give you a chance to respond before we close an account.

If a mess is closed, its members can no longer use it in the app. Any member can still ask us for a copy of their records, and we answer within 30 days.


Changes

11. Changes to these Terms

We may update these Terms. We update the dates at the top and summarise what changed in a note below them. A change applies only from when we publish it, never to a dispute that has already arisen. We tell mess owners about important changes in advance, in writing. The current version is always at cloudmess.in/terms. The copy inside the apps (Settings → Terms of Service) is updated with each app release.

If you do not accept a change, you can stop using the Apps and ask us to delete your account.


Complaints

12. Complaints and our Grievance Officer

You can complain about anything on CloudMess, including content that breaks §6 or how your data is handled, to our Grievance Officer: Sujit Kadam, Founder, at contact@infiworks.co.in, on +91 74834 01547 (call or WhatsApp), or by post to the address in §15.

  • We acknowledge every complaint within 24 hours and resolve it within 7 days.
  • A request to remove content that breaks §6 is resolved within 36 hours, except where it concerns someone else’s rights, intellectual property, or a general breach of the law.
  • If the complaint is from a person shown in content that exposes their private areas, shows them nude, or impersonates them (including morphed images), we act to remove it within 2 hours.
  • We act on court orders and lawful government directions within the times the IT Rules set.

If you are not satisfied with our decision, you can appeal to the Grievance Appellate Committee at gac.gov.in within 30 days.


Governing law

13. Governing law and disputes

  • These Terms are governed by the laws of India.
  • If you have a dispute with us, please write to us first; we will try to settle it within 30 days. This does not stop either of us from going to a court or a consumer forum.
  • Subject to the next point, the courts at Beed, Maharashtra, where our registered office is, have exclusive jurisdiction.
  • Nothing here affects any right you have under the Consumer Protection Act, 2019, or any other law, to go to a forum where you live or work.

General

14. General

  • These Terms, our Privacy Policy and, for mess owners, your subscription confirmation are the whole agreement between you and us about the Apps.
  • If a court finds any part of these Terms unenforceable, the rest still applies.
  • If we do not enforce a term straight away, we can still enforce it later.
  • We may transfer these Terms to a company that takes over our business. That will not reduce your rights.
